CONTRACTING TERMS AND CONDITIONS OF USE ON THE ONLINE SHOP OF ECCOCIWINE
Our website is directed and can only be used by persons of legal age, that is, 18 years of age, and with legal capacity to bind themselves. You are solely responsible for the veracity of the data you provide us. The HOLDER reserves the right to carry out all the verifications that are necessary in order to verify the veracity of your data, expressly reserving their right to block and/or cancel your account in those cases where there is a reasonable certainty or doubts about its veracity and accuracy. These actions do not give right to any compensation or indemnity.

2.- IDENTIFICATION OF THE SERVICE HOLDER
In accordance with article 10 of Law 34/2002 of July 11, on services of the information society and electronic commerce, the owner of the service is ECCOCIWINE SL with NIF B17536764 and address in Sant Martí Vell (17462), Paratge Mont-Rodó 3 and registered in the Commercial Register of Girona, Volume 1144, Folio 95, Sheet GI-20644, Registration 1ª.
Eccocivi puts at your disposal an online service, in order to facilitate to the registered user the purchase of its wine production.
4.- CHARACTERISTICS OF THE SERVICES AND FUNCTIONALITIES.
4.1. Access and use of our services
To access our services you must register and acquire the status of a registered user. To do this, you must fill out an online form in which we will request your name and an email address. Once the registration is requested, we will send your password (which you can modify) to the email address provided. The password is private, protected by encryption and will not be shared with third parties, except with your express authorization. Registration on our website is free; once you have acquired the status of registered user you can buy our products.
The password is unique, non-transferable and confidential. As a registered user, you must make proper use of it and ensure its integrity, exonerating ECCOCIWINE SL from any responsibility for improper use of it. In the event of any incident you may have, please contact us as soon as possible by sending an email to firstname.lastname@example.org.
4.2. Purchasing Process
As a registered user you can already access our online store; you only have to select which product you want to buy and how many units of it; check the “shopping cart” icon and your choice will automatically be incorporated into your “basket” of products.
The next step is to place the order. The first time you purchase our products in our online store we will ask you for the following information: name and surname, destination country, address, postal code, town and telephone. We need all these data to send you your purchase and also to issue the invoice if you request it from us.
5.1. Product prices
The prices of our products are expressed in Euros and include the Value Added Tax (VAT will apply those in force at the time of confirming and paying the order, regardless of the day of delivery). If you are the beneficiary of any type of discount and/or promotion, this circumstance must be stated during the order confirmation process.
Eccocivi reserves the right to cancel those orders in which it detects that there is some kind of error, or inaccuracy, either in the price or in the nature of the product. Such cancellation will be communicated to the interested parties as soon as possible through the usual channels of contact and this will not give right to any compensation from our part, only the amounts paid by the client will be refunded, in the maximum term of 7 working days. The amounts will preferably be refunded in the same way as they have been paid by the client.
Likewise, Eccocivi guarantees the existence of all the products offered on www. eccocivi.com, in case of not having availability of the same, the Client will be informed in due time.
6.- ORDERS DELIVERY
6.1. Territorial scope: Our online order delivery service is only available in the Spanish territory of the Iberian Peninsula except in the territories of Ceuta, Melilla, the Canary Islands and the Balearic Islands.
The order will be delivered to the address informed by the client, and at the time established for this purpose. At the time of delivery, the Customer will identify himself and must sign the delivery note that will certify receipt of the order. If you observe any damage or are not satisfied with the package received, you must state it on the delivery note, and send us a copy of it, within a maximum period of 48 hours from receipt, as long as you have not opened the package, since in this case we will not be able to manage the return given the special nature of the product that we commercialize. All without prejudice to the right of withdrawal that assists you and that we explain in point number 9 of these Conditions.
6.2. Delivery cost: The delivery costs are, at the date of these conditions, 12 Euros (VAT included) per order.
6.3. Delivery time: The delivery time is 48 to 72 hours. The computation will start from the day the order is confirmed.
If there is no reason to prevent it, deliveries will be made from Monday to Friday, not bank holidays. Eccocivi will not assume any responsibility for the delay in delivery when it is attributable to the company that manages the transport, or to the Client.
Eccocivi provide you with 2 payment methods:
7.1. Through the PayPal service: ECCOCIWINE SL does not have access to or store the bank details linked to the described payment method. Before proceeding with the confirmation of the transaction, a screen will appear that will show each and every one of the terms and costs of the transaction. If you agree, you must accept and confirm it.
7.2 Through the service provided by Stripe: ECCOCIWINE SL does not have access to or store the bank details linked to the described payment method. We remind you that when you use online payment platforms, or pay by bank card, you directly access the services of these financial service providers, over which Eccociwine does not exercise any type of control, and this is why we recommend that you read carefully the privacy policies and data protection of these providers, and that in case of doubt contact them.
8.- ORDERS CONFIRMATION
Once we receive confirmation of payment of your order from the financial institution, we will send you a detailed confirmation of the order to the email address that you have provided in the registration form. This confirmation will contain an order number, reference that will be useful in those cases in which you want to make a query about it. This confirmation will also include the estimated delivery time.
Once the payment of the order by our financial service providers has been confirmed, we will proceed to prepare it and make the delivery in the terms and terms detailed in point 6 of these conditions.
9.- RETURN RIGHTS
The customer has a period of 14 natural days to exercise the right of withdrawal, as long as the package has not been opened and unsealed. The computation of this period will start from the day after receiving the order. If you have decided to withdraw from the purchase, you must notify us, within the same period, by sending an email to firstname.lastname@example.org. In this email, you must attach a copy of the delivery note or purchase invoice, as well as indicate a phone number or email address to contact you.
The costs of returning the order will be at your expense.
The right of withdrawal will not apply, given the perishable nature of our product and in accordance with article 103 sections d) and e) (exceptions to the right of withdrawal), in those cases in which the package has been unsealed.
9.1. Procedure to exercise the right of returning an order:
Once we receive the email in which you express your wish to withdraw, we will contact you within a maximum period of 48 hours to manage this return. Except in some specific cases that will be discussed in a private way with the client, in general terms, once we receive the product, together with the delivery note and verified that it is in perfect condition, we will proceed to refund the amounts paid out by you, in the same way that they were paid, within a maximum period of 11 natural days.
10.- NULLITY AND INEFFECTIVENESS OF THE CLAUSES
If any clause included in these General Conditions is declared totally or partially invalid or ineffective, this invalidation or ineffectiveness will only affect the clause in question partially or totally. The rest of the clauses which make up these General Conditions are valid and it will be considered that such clause in whole or in part as not included.
11.- LIFE AND MODIFICATIONS OF THE SERVICE TERMS
These conditions have been drawn up on 1st of July 2020, they will be effective immediately from their publication on our website.
ECCOCIWINE SL may modify without notice and at any time and in accordance with current legislation these Conditions, including economic conditions, whether for legal, technical, operational, economic, service or market reasons or as a consequence of the organization or needs of the service, including those modifications tending to adapt these conditions to the fluctuations of our business activity, or to market variations.
ECCOCIWINE SL will conveniently inform you of these modifications so that you accept them and continue as a user of our website.
12.- APPLICABLE LEGISLATION AND COMPETENT JURISDICTION
These conditions must be interpreted and submitted to the Spanish law in general and to the Autonomous Community of Catalonia in particular, both parties submitting to the Courts and Tribunals of the city of Girona, renouncing expressly any other jurisdiction that may correspond to them.
